Terms of Service

1. Agreement to these terms
These terms govern your use of DiaryWorx, a WhatsApp-based booking management service that is part of the ChatWorx ecosystem. By subscribing to or using DiaryWorx, you agree to be bound by these terms. If you do not agree, please do not use the service.
2. The service
DiaryWorx lets you manage your diary by sending WhatsApp voice notes, photos or text messages. It transcribes and interprets your messages to create, view, reschedule and manage events in your connected Google or Apple calendar.
The service is intended for sole traders and small businesses to manage their own bookings. You must have an active subscription and a connected calendar to use it.
3. Subscription and payment
- DiaryWorx is offered on a subscription basis at £19.99 per month.
- Payment is collected in advance by Stripe. Your subscription renews automatically each month until you cancel.
- You can cancel anytime — there is no contract, minimum term or cancellation fee. You can cancel from the cancellation page or your billing portal.
- When you cancel, you keep access until the end of your current paid period. We do not provide pro-rata refunds for partial months unless required by law.
- We may change the subscription price from time to time. We will give active subscribers reasonable notice by email before any price change takes effect.
4. Acceptable use
When using DiaryWorx you agree that you will:
- Use the service only for lawful purposes and in line with these terms;
- Provide accurate account information and keep your WhatsApp number up to date;
- Be responsible for the content you send and for any customer data you enter into your calendar;
- Not resell, sublicense or share your account, or use it on behalf of unrelated third parties;
- Not attempt to disrupt, reverse engineer, overload or gain unauthorised access to the service or its underlying systems;
- Not use the service to send unlawful, abusive or infringing content.
We may suspend or terminate accounts that breach these terms or that put the service or other users at risk.
5. What we do and don't guarantee
DiaryWorx is provided on an "as is" and "as available" basis. We work hard to make it reliable, but you acknowledge that:
- Voice, photo and text interpretation is performed by automated AI systems and may occasionally be inaccurate or incomplete. You are responsible for checking that bookings are correct in your calendar.
- We do not guarantee that the service will be uninterrupted, error-free, or available at all times. It depends on third-party services (including WhatsApp, Twilio, Google, Apple, and AI providers) that are outside our control.
- To the fullest extent permitted by law, DiaryWorx is not liable for missed, duplicated or incorrect bookings, lost business, or any indirect or consequential loss arising from use of the service or any downtime.
- Nothing in these terms excludes or limits liability where it would be unlawful to do so, including for death or personal injury caused by negligence, or fraud.
6. Data and privacy
We handle your personal data in line with our Privacy Policy, which explains what we collect, how we use it, the sub-processors we rely on, and your rights under UK GDPR. By using DiaryWorx you also agree to the handling of your data as described there.
7. Cancellation and termination
You may cancel your subscription at any time, and you may request deletion of your account and data as set out in our Privacy Policy. We may suspend or end your access if your payment fails, if you breach these terms, or if we discontinue the service, in which case we will give reasonable notice where practical.
8. Changes to these terms
We may update these terms from time to time. Material changes will be communicated by email to active subscribers. Continuing to use the service after a change means you accept the updated terms.
